1. Acceptance of Terms

By creating an account, placing an order, or using any feature of the PropDue platform (the “Service”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service.

These Terms constitute a binding agreement between you and PropDue (“we”, “us”, “our”). We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice on the platform. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

2. Description of Services

PropDue is an AI-powered property intelligence platform designed to help foreign buyers research residential property in Spain. Our services include:

• Area Match — a free tool to help you identify areas in Spain that match your lifestyle and budget criteria.
• Property Cost Calculator — a free tool that estimates the true cost of buying a specific property, including transfer tax, notary and registry fees, and annual running costs, personalised to your nationality and autonomous community.
• Legal Review — a paid service that compiles publicly available legal and administrative information related to a specific property, including title deed status, ownership records, and any noted encumbrances, for your review prior to engaging a lawyer.
• Partner Network — a free introductory service that connects you with vetted third-party professionals (lawyers, mortgage brokers, currency specialists) to assist with your transaction. PropDue receives a referral fee from these professionals; this does not affect the fee you pay them.

All services are delivered in English. The Service is intended for personal, non-commercial use.

3. Not Financial, Legal, or Professional Advice

Nothing on the PropDue platform — including any report, tool output, guide, article, email, or communication from our team — constitutes financial advice, investment advice, legal advice, mortgage advice, tax advice, or a professional property valuation.

Our reports are compiled from publicly available data sources using AI-assisted analysis. They are intended to provide background information to help you ask better questions of the qualified professionals you engage. They are not a substitute for:

• A structural survey carried out by a qualified surveyor
• Legal due diligence conducted by a licenced Spanish abogado (lawyer)
• A formal property valuation (tasación) by a regulated valuer
• Mortgage advice from a regulated financial adviser or broker
• Tax advice from a gestor or tax professional familiar with your personal circumstances

You should not enter into any binding agreement, pay any deposit, or transfer any funds on the basis of a PropDue report alone. Always obtain independent professional advice specific to your situation.

4. Data Accuracy and Limitations

Our reports draw on public data sources that may be incomplete, out of date, or inaccurate. In particular:

• Catastro records may not reflect recent construction, renovations, or illegal extensions.
• Land Registry (Registro de la Propiedad) data is a snapshot and may not reflect very recent transactions or encumbrances.
• Comparable listing data is drawn from publicly available property listings and represents asking prices, not transaction prices.
• AI-generated analysis may contain errors. No AI system is infallible.

We make no warranty, express or implied, as to the accuracy, completeness, timeliness, or fitness for purpose of any information provided through the Service.

5. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement. The Service is available to users worldwide; however, we make no representation that it is appropriate or available in every jurisdiction.

6. Accounts and Registration

To place a paid order, you must provide a valid email address. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. Please notify us immediately if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that are used in breach of these Terms, or where we reasonably believe fraudulent or abusive activity has occurred.

7. Payment and Refunds

Paid services are priced in euros (€) and processed securely via Stripe. All prices are inclusive of any applicable VAT where required by law.

Because our reports are generated and delivered digitally, you expressly acknowledge that delivery of your report begins immediately upon payment and that you waive any right to a cooling-off period that may otherwise apply under applicable consumer protection law.

If your report cannot be completed due to a technical failure on our part (for example, we are unable to retrieve Catastro data for the address provided), we will offer you a full refund. We do not offer refunds because you disagree with the findings of a report or because a property transaction does not proceed.

8. Intellectual Property

All content on the PropDue platform — including but not limited to text, reports, tools, design, code, and guides — is owned by or licenced to PropDue. You may not reproduce, distribute, resell, or create derivative works from any PropDue content without our express written permission.

Your PropDue report is licenced to you for your personal use in connection with the specific property you are researching. You may share it with your lawyer or financial adviser for that purpose.

9. Prohibited Uses

You may not use the Service to:

• Resell or commercially exploit reports without our prior written consent
• Submit false, misleading, or fraudulent property data
• Attempt to reverse-engineer, scrape, or systematically extract data from the platform
• Impersonate any person or entity
• Use the Service in any manner that could damage, disable, or impair it

10. Limitation of Liability

To the fullest extent permitted by law, PropDue's total liability to you for any claim arising out of or in connection with the Service shall not exceed the amount you paid for the specific service giving rise to that claim.

We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profit, loss of data, or loss of a property transaction, however caused and under whatever theory of liability.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

11. Data Protection and Privacy

We process your personal data in accordance with our Privacy Policy and applicable data protection law, including the EU General Data Protection Regulation (GDPR). By using the Service, you confirm that you have read and understood our Privacy Policy.

We will never sell your personal data to third parties. Where we share your data with vetted professionals as part of the Partner Network service, we do so only with your explicit consent and only for the purpose of facilitating your property transaction.

12. Changes to These Terms

We reserve the right to update these Terms at any time. Where changes are material, we will provide at least 14 days' notice by email before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Spain. Any disputes arising from these Terms or the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain, unless applicable consumer protection law in your country of residence provides otherwise.
